Are you in compliance with Local Law 78 of 2017?

All construction incidents that result in an injury or fatality must be reported to a member of the public or a construction worker. All property owners, contractors, subcontractors, or supervisors are required to report specific information about any of construction site injuries or fatalities within three business days after the occurrence of such incident. Failure to do so can result in a civil penalty ranging from $1000-$25,000. OSHA Proposes Rule to Ensure Crane Operators Are Qualified
To Safely Operate Equipment

On May 18th 2018, OSHA announced a proposed rule to increase the safety of America’s construction sites. In addition to providing long-term clarity regarding crane operator certification requirements, the proposal reinstates the employer duty to ensure that a crane operator is qualified to safely operate equipment. Under the proposed rule, a change to the categories of certifications for crane operators would ensure more operators are able to meet the requirement. The proposal discontinues a 2010 requirement, which never went into effect, that crane operator certification must include the crane lifting capacity for which the operator is certified.

DOB ANNOUNCES CONSTRUCTION SAFETY TRAINING REQUIREMENTS

On May 9th, 2018, Buildings Commissioner Rick Chandler announced an increase in the hours for safety training requirements for many of the city’s construction workers. DOB will mandate that workers at certain job sites must have 40 hours of safety training and that supervisors must have 62 hours of training. These requirements will take effect in stages over the next 12 to 28 months. The safety-training requirements announced will apply to workers at sites for which DOB requires construction superintendents, site-safety coordinators, or site-safety managers.

Pre-Shift Safety Meetings

Effective May 16, 2018, permit holders at sites that require the designation of a Site Safety Manager, Site Safety Coordinator, or Construction Superintendent must ensure each construction or demolition worker at the site takes part in a safety meeting at the beginning of the worker’s shift, before the worker begins any construction or demolition work in the shift. Civil Penalties Increased for Violation of a Stop Work Order (SWO)

The civil penalty for failure to comply with a Stop Work Order is increased to $6,000 for the initial violation and $12,000 for every subsequent violation, to be paid to the Department prior to the rescission of the Stop Work Order. Click here to read the service update.

General Industry and Maritime Silica Standard Effective June 23

General industry and maritime employers must comply with OSHA’s  silica standard  by June 23, except for phase-in dates for medical surveillance and for engineering controls in the oil and gas industry. June 12 is National Forklift Safety Day

National Forklift Safety Day will be recognized on June 12 in Washington, D.C., and workplaces nationwide.
